The maximum penalty is 6 months jail or a $1000 Fine for a first offence if prosecuted Summarily; and 1 year jail or $2000 Fine for a subsequent offence. If the charge is prosecuted indictable, the maximum penalty is 7 years imprisonment. Depending on the weight of the drugs found will play a role in whether the charge is prosecuted Summarily or by Indictable.
