D. Lea Scardicchio

Ms. Scardicchio is Litigation Counsel called to the Ontario Bar in 2012 and is a Member in good standing with the Law Society of Ontario.  With over a decade of experience, Lea Scardicchio has appeared at various levels of court in Ontario, including the Court of Appeal for Ontario, the Ontario Superior Court of Justice, and the Ontario Court of Justice.  She regularly appears at the A. Grenville and William Davis Courthouse in Brampton, as well as courts across Toronto, Milton, Burlington, Newmarket, Orangeville, Oshawa and Hamilton.  Before getting called to the Bar, Ms. Scardicchio completed her Articles of Clerkship jointly with the now Honourable Alison Mackay who presides in Brampton, and the notable Brian E. Starkman, practicing exclusively in criminal defence.  Ms. Scardicchio is a member of the Criminal Lawyers’ Association, the Peel Lawyers’ Association, the Peel Criminal Lawyers’ Association, York Region Law Association, and the Ontario Bar Association.  In addition to Ms. Scardicchio’s focused criminal practice, she has also represented clients on trials and mediations of the firm’s civil and plaintiff personal injury cases.

R v. A.S., 2020 ONCA 229

On Appeal from the conviction and sentence imposed at the Ontario Court of Justice in Newmarket.  Appeal successfully allowed and a new trial ordered.  Crown stayed charges at the trial level.

Ms. Scardicchio conducted one of the first trial continuation matters by remote video conferencing before The Honourable Justice Renwick in the Brampton courthosue during the Covid-19 pandemic.  The case of R v. J.M. (2020) was a successful Charter delay argument under section 11(b).

Do you accept Legal Aid cases?

Yes. We accept Legal Aid Certificates.  You must contact Legal Aid Ontario and discuss your eligibility criteria and once you are issued a certificate you may contact our office.

What is a Peace Bond?

A Peace Bond is a court order which requires you to keep the peace and be of good behaviour for a period of time (usually 12-months).  Entering into a peace bond generally means that the Crown will withdraw your criminal charges and instead requires you to be on a court order.  Peace bonds often have conditions, such as not having any weapons or keeping distance or communication from a person or place.

What can I expect at my first court appearance?

On your first court date, if you are not in custody and you are unrepresented, you can expect to stand before a Justice of the Peace and advise the court whether you intend to hire a lawyer or seek legal aid assistance with your case. Covid-19 has drastically changed the manner in which you may attend your first court date.  First appearances may be held by video conference Zoom or other methods as outlined by your release documents. 

You may or may not receive a disclosure package from the Crown on this date. You will also be required to set a return date in order to advise the court as to how you will be proceedings with your case. It is advisable to secure legal representation prior to your first court date. A lawyer will be able to secure your rights from the beginning. For example, there are important statements about your case that may need to be addressed before the court and reflected on the record, which only an experienced criminal lawyer can do to protect your rights from the start. Having a lawyer from the beginning of your case will give you the leading edge to ensure the best possible outcome.

How do I remove my fingerprints from the Police?

Our services include instructing you on how to remove your fingerprints to the police agency and requesting that the fingerprints and photograph be expunged from the police system.  If your charges have been withdrawn of discharged, we can assist with this service.
