If you have been charged with possession of cocaine or another schedule drug, the Controlled Drugs and Substances Act, section 4, under the Criminal Code of Canada outlines different forms of possession. There are three types of possession: personal or actual possession; constructive possession and joint possession. At common law, possession requires control and knowledge. The statutory requirements are found under section 4(3) of the Act. Possession of cocaine or heroin is a hybrid offence where the Crown can elect to prosecute Summarily or Indictable. The maximum penalty is 6 months jail or a $1000 Fine for a first offence if prosecuted Summarily; and 1 year jail or $2000 Fine for a subsequent offence. If the charge is prosecuted indictable, the maximum penalty is 7 years imprisonment. Depending on the weight of the drugs found will play a role in whether the charge is prosecuted Summarily or by Indictable.
